By using Smart Light you accept these terms. Please read carefully Section 5 on Contracting and Mandate if you plan to contract a tariff through our platform.

1. Introduction and Acceptance

Welcome to Smart Light. By accessing or using our website (the "Site"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.

2. Description of Service

Smart Light is a technology platform that offers:

  • Comparison of electricity and gas tariffs.
  • Calculation tools for solar installations, batteries, and electric vehicles.
  • Information and analysis of the energy market.

Important: Smart Light is NOT an energy supplier. We do not sell energy directly. We act as informational intermediaries and facilitators.

3. Use of the Site

You commit to:

  • Provide truthful and accurate information in forms and calculators.
  • Not use the Site for illegal or unauthorized purposes.
  • Not attempt to access restricted areas or interfere with Site security.

4. Accuracy of Information and Disclaimer

Although we strive to keep information updated, supplier tariffs and conditions change constantly.

  • Indicative prices: Prices shown are estimates based on publicly available information or provided by partners. The final price will always be that in your contract with the supplier.
  • Calculators: Solar/battery calculator results are simulations based on averages and theoretical data. Actual performance may vary.
  • No guarantee: Smart Light does not guarantee the accuracy, completeness, or timeliness of information. We are not responsible for errors or omissions.

5. Contracting and Mandate

5.1 Direct Contracting Model

Smart Light allows contracting of electricity tariffs without leaving the platform. The user completes a form on our website and we manage sending the request to the selected supplier.

5.2 Representation Mandate

By completing the contracting process, you grant Smart Light Energy S.L. a limited representation mandate (Articles 1709-1739 of the Spanish Civil Code) to:

  • Request the supplier switch in your name.
  • Provide your personal data (DNI, CUPS, address) and banking data (IBAN) to the selected supplier.
  • Manage the ATR (Third Party Access to the Grid) procedure.
  • Receive activation and renewal confirmations.

Mandate limitations:

  • It is special and temporary: only for the specific contracting you select.
  • It expires automatically when the process is completed (Model A) or upon subscription cancellation (Model B).
  • You can revoke the mandate at any time before contract activation without cost or penalty.

5.3 Relationship with the Supplier

Smart Light acts as intermediary/representative, but is NOT a party to the supply contract. The final contract is between you and the selected supplier. Any claims regarding supply, billing, or service must be directed directly to the contracted company.

5.4 Autopilot Service (Model B)

The Autopilot Service (€9/year) includes an extended representation mandate to:

  • Continuously monitor the electricity tariff market.
  • Propose tariff changes when we detect significant savings (>€50/year).
  • Automatically execute the change if you do not exercise your veto right within 72 hours.

Veto right: You will always receive prior notification by email and can reject any proposed change within 72 hours without cost or penalty.

6. Intellectual Property

All content, design, logos (except third-party logos), graphics, and code on this Site are the exclusive property of Smart Light or its licensors and are protected by intellectual property laws. Reproduction, distribution, or modification without express authorization is prohibited.

7. Modifications

We reserve the right to modify these Terms at any time. Changes will take effect immediately after publication. Continued use of the Site implies acceptance of the new terms.

8. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. For any dispute, both parties submit to the courts and tribunals of the user's domicile (if a consumer) or the city of Madrid (otherwise).
